Bort Jones v. Murdoch, 2009-NMSC-002 , changed the way grand juries could be challenged in the State of New Mexico. Before this case there was little a target, the person that is the focus of the grand jury investigation, could do to challenge that investigation. Commonly, the investigation resulted in a true bill, or the grand jury finding that there was probable cause that a crime was committed and that the target probably committed that crime. A Bort Jones letter, codified by Rule 302A governs what materials may be provided to the prosecutor, including questions that can be asked of the State’s witnesses. Should you receive a target letter call 505-247-9500 for a free consultation and a further explanation of how a Bort Jones package may be helpful in your case.
