Scheduling Conferences in Criminal Cases

In Bernalillo County, also known as the Second Judicial District, the Court pursuant to Local Rule 308 (Case management pilot program for criminal cases).  As the rule states, “This is a special pilot rule governing time limits for criminal proceedings in the Second Judicial District Court.”  In a nutshell the rules establishes time limits on when a case must proceed for trial based on several factors, including but not limited to, number of witness, the evidence to be presented, such as scientific evidence, and the complexity of the case.  The Court then based on these factors assigns the case to a track schedule.  There are three tracks.  Track 1 is for simple cases like a DWI and basically sets a six month deadline for the case to be set for trial.  Track 2 is for moderately complex cases and track 3 is for the most complicated cases and sets the case for a trial 455 days from arraignment.  The track assignment sets deadlines for various aspects of the case such as witness interview deadlines (see our post on witness interviews here  ), disclosure of scientific evidence, motions deadlines (for a that discussion see here ), and a plea deadline.  If you have a criminal case please call for a free consultation at 505-247-9500.  This post does not create an client-attorney relationship and is for informational purposes only.  If you have further questions about scheduling consultations please contact a lawyer or schedule a free consultation.
